Terms of Service

These Terms of Service govern access to and use of the Southeast Military Equipment website and the purchase of products and services from us. By using the website or placing an order, the customer agrees to these Terms.

Products and descriptions

We make reasonable efforts to describe products accurately. Inventory may include new, new old stock (“NOS”), remanufactured, and used takeout products. Condition definitions form part of these Terms.

Photographs may show the actual product or a representative example, as stated in the listing. Color, packaging, markings, and minor cosmetic details may vary. Unless expressly stated, accessories, mounting hardware, manuals, licenses, and other items shown near a product are not included.

Part numbers and fitment

Part numbers, NSNs, vehicle applications, cross-references, and fitment information are provided as identification aids. The customer is responsible for verifying that a product is appropriate for the intended vehicle, configuration, and use.

No fitment statement overrides an observable mismatch, field modification, superseded component, or customer-provided specification. Contact us before ordering when fitment is uncertain.

Orders

We may accept, reject, limit, or cancel an order for reasons including inventory errors, incorrect pricing, suspected fraud, payment problems, export restrictions, legal restrictions, or inability to fulfill the order.

An automated confirmation acknowledges receipt of the order but does not constitute final acceptance. If we cancel a paid order, we will refund the canceled amount to the original payment method.

Prices, payments, and taxes

Prices are stated in U.S. dollars unless otherwise indicated. Taxes, shipping, freight, duties, brokerage charges, and other applicable costs may be additional.

Pricing errors may be corrected before shipment. We will request approval before charging a corrected higher price.

Returns and shipping

Purchases are subject to our Return and Refund Policy and Shipping Policy, which are incorporated into these Terms.

Complete vehicles and quotation items

Complete vehicles, major assemblies, and high-value or freight-intensive products may require a separate quotation, invoice, purchase agreement, deposit, inspection, or transportation arrangement.

Vehicle mileage, hours, condition, title documentation, known defects, and included equipment will be stated to the best of our knowledge. Customers are encouraged to inspect vehicles personally or through a qualified representative before purchase.

Legal use and export compliance

Customers may not purchase, export, re-export, transfer, resell, or use products in violation of applicable laws, sanctions, export controls, licensing requirements, or end-use restrictions.

We may request identity, destination, end-use, or business information before completing a transaction.

Manufacturer relationships

Unless expressly stated, Southeast Military Equipment is not affiliated with, endorsed by, or sponsored by the United States Department of Defense, Oshkosh Corporation, or any vehicle, equipment, or component manufacturer. Names and part numbers are used for identification and compatibility purposes.

Warranty disclaimer

Any express warranty applicable to a product will be stated in its listing or accompanying written documentation. Manufacturer warranties, when available, are provided by the manufacturer and may be subject to separate terms.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRODUCTS ARE OTHERWISE PROVIDED IN THEIR DESCRIBED CONDITION AND WITHOUT ADDITIONAL WARRANTIES BY SOUTHEAST MILITARY EQUIPMENT, WHETHER EXPRESS OR IMPLIED. NOTHING IN THESE TERMS EXCLUDES A WARRANTY OR CONSUMER RIGHT THAT CANNOT LAWFULLY BE DISCLAIMED.

Used takeout and NOS parts may have age-related or prior-use characteristics described in the applicable condition definitions.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOUTHEAST MILITARY EQUIPMENT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF USE, TOWING, LABOR, DOWNTIME, OR DAMAGE CAUSED BY IMPROPER INSTALLATION OR USE.

OUR AGGREGATE LIABILITY RELATING TO A PRODUCT WILL NOT EXCEED THE AMOUNT PAID FOR THAT PRODUCT, EXCEPT WHERE A DIFFERENT LIMIT IS REQUIRED BY LAW.

Installation and safety

Products should be inspected and installed by qualified personnel using appropriate procedures and specifications. The customer is responsible for determining suitability, safe installation, required programming, torque specifications, and compliance with applicable vehicle, workplace, environmental, and safety requirements.

Intellectual property

Website text, photographs, branding, graphics, and other original content belong to Southeast Military Equipment or their respective licensors and may not be reproduced or commercially used without permission.

Governing law

These Terms are governed by the laws of the State of [STATE], without regard to conflict-of-law principles. Any dispute will be brought in an appropriate court located in [COUNTY AND STATE], except where applicable law requires otherwise.

Changes

We may update these Terms by posting a revised version with a new effective date. Changes do not retroactively alter completed transactions unless required by law.
